A COUNCIL’S battle to control noisy motor vehicle sports on an airfield near York has taken a new twist at the High Court in London.

Elvington Park Limited has been given permission to appeal against a planning inspector’s decision last November to throw out an appeal against a planning enforcement notice issued by City of York Council.

The notice claimed there had been such a substantial intensification in motor vehicle activity on Elvington Airfield that it constituted a change of use requiring planning permission. Local residents lined up for and against vehicle sports at a public inquiry. A spokesman for Elvington Park Limited said it was convinced the enforcement action was wrong because it ignored significant historic motorsport activity that had taken place at the airfield since the 1960s.

The council said it intended to be represented by counsel at a hearing to support the Secretary of State in opposing the challenge.
