A STAG party attender who started pub violence that left one man unconscious and another with a “substantial” injury near his eye has been given an eight-month suspended prison sentence.

Scott Kelly has also been ordered to pay £1,000 compensation to victims of the violence and to stay at his home address between 8pm and 5am every night for the next three months.

“That hopefully will keep you away from any drinking establishments during that time,” Recorder John Baird told him at York Crown Court. “You richly deserve to go to prison for your part in this affray.”

Simon Waley, prosecuting, said Kelly head-butted someone in the Three Cranes on St Sampson’s Square without provocation.

That sparked a brawl during which Kelly “still fighting” was “pulled out” of the pub. Outside, he hit another man who fell to the ground and remained unconscious for a period.

The fight started shortly before 8pm on Saturday March 3 and Kelly, who had come to York for a stag party, had been drinking since 1pm, said Mr Waley.

Kelly, of Ingram Close, Holbeck, pleaded guilty to affray and was given an eight-month prison sentence suspended for 12 months on condition he does 200 hours’ unpaid work, the three-month curfew and pay £500 each to the man who suffered the eye injury and the man knocked unconscious.

For him, Chris Smith said he regretted his actions, which had been out of character.

“Immediate custody would be catastrophic not just for him, but also for other members of the family,” he said

Mr Waley said the first victim suffered a “substantial” injury near his eye that prevented him seeing properly for a time.
