PLANS to open a takeaway in a former newsagent’s shop have been refused by planning officers for the second time in 12 months.

Mr M Gere had applied to Scarborough Council to open the unit selling hot food at 9 Byland Road, Whitby, which was previously home to Byland News.

However, concerns over the impact that smells and noise from the new business would have on near-neighbours has seen the council’s planners withhold approval.

Last year, Mr R Selvachandran was also refused permission to open a takeaway at the same premises, which closed in 2018.

Whitby Town Council had recommended that the most recent plans be given the green light, but one member of the public and Whitby Civic Society objected.

Planning officers refused the application under delegated powers, stating: “Due to the constraints of the site with residential properties located above/adjacent to the unit, the proposed use and specifically

the extraction system would give rise to unacceptable noise, vibration and odour resulting in a detrimental impact upon residential amenity.”
