A BRUTE who burned his pregnant girlfriend with a cigarette lighter failed in an Appeal Court bid to win a cut in his sentence.

Stephen Gary Smith, of East Mount Road, Holgate, York, was jailed for 12 months at York Crown Court in July after he pleaded guilty to offences of affray and common assault.

He was also given an extended licence period of a further 18 months.

Lord Justice Moses, sitting with Mr Justice Gibbs and Mr Justice Cooke at the Appeal Court in London yesterday, refused to cut Smith's sentence - dismissing an argument it was "manifestly excessive".

Lawyers on Smith's behalf argued the "extended" sentence was too long given the circumstances of the case.

But refusing the application, Lord Justice Moses said the application was "not arguable".
