A JURY has found a former York psychiatrist accused of raping an indecently assaulting former patients unfit to plead because of mental impairment.
But a hearing will still take place before another jury in November to determine whether Dr William Kerr "did the acts alleged".
Dr Kerr, 74, of Alne, near Easingwold, a retired consultant psychiatrist, was charged in 1998 with four rapes and 15 indecent assaults against former patients at York, Harrogate, Knaresborough, Ripon, Ferrensby and Newton-on-Ouse.
The alleged offences took place between the 1960s and 1980s.
The jury reached its decision that he was unfit to plead in April but this could not be reported until today.
Mr Justice Hooper ruled today at Leeds Crown Court that there should be another hearing at Leeds, beginning in November, to determine whether Dr Kerr did the alleged acts. The judge will give the reasons for his decision on Monday.
