A MAN accused of raping a woman as she slept told a jury “I was asleep all night”.

Michael McConachy claimed there had been no sexual activity between the pair, although they shared a bed.

McConachy, 22, of Trevor Grove, Holgate, York, denies rape.

The prosecution claims McConachy’s actions woke the woman.

She managed to activate her phone and a friend’s voicemail allegedly recorded the woman objecting to McConachy’s actions.

Giving evidence at Teesside Crown Court, McConachy said he had been drinking cocktails, Jager-bombs and vodka and cokes during a night out in York and was unable to get home.

He was invited to stay at the woman’s house and that on a scale of one to 10 of drunkenness, he was seven or eight.

He alleged the pair went to sleep “pretty much straight away” because they were both very drunk and he was woken by the woman at 9.40am the next day.

McConachy denied that he had tried to kiss the woman in a York nightclub or that he fancied her.

Jonathan Dickinson, prosecuting, asked: “Can you think of any reason why she would be complaining to people that you had raped her?”

McConachy replied: “No reason at all.”

Mr Dickinson asked: “Is it not simply the case that you woke up, still drunk, effectively wanting to have sex with her?”

McConachy said: “No, I was asleep all night.” Mr Dickinson alleged: “She woke up, understandably told you to get off and you could not stop yourself.”

McConachy said: “No, this never happened. False allegation.”
