THE son of a military hero and former royal aide who swindled his mother out of nearly half a million pounds must hand over £194,134, a judge has decided.

Capt Michael Pain was jailed for 32 months in 2010 for his crimes against his mother Lady Denys Pain of Eddlethorpe Hall, near Malton.

York Crown Court heard then how his sisters trusted him to look after her when their father Lt-Gen Sir Rollo Pain, who was awarded the Military Cross in 1945, died in 2005.

He lived on the family estate near Malton and they lived either in a distant part of the country or abroad.

Pain turned off their mother's heating and claimed it was broken. He told her family she was spending too much as he reduced her to a penniless pensioner while he used her money to subsidise his business and family.

When he returned to York Crown Court for an assets confiscation hearing, Judge Simon Hickey heard that Pain had benefited by £451,546 from his crimes.

A police investigation into his finances found he had £194,134 of assets that could be confiscated.

The judge ordered him to hand over the assets.

Pain, now 60, formerly of the Royal Dragoon Guards and owner of an equestrian business at his home on the family estate, pleaded guilty to theft, five frauds and two offences of obtaining a money transfer by deception.

The offences were committed between April 1, 2005, and February 2, 2009.

York Crown Court heard in 2010 how Pain's older sister uncovered his lies and fraud during a visit from her home in Dubai and that Lady Pain had refused to have anything to do with her son since then.

The court heard Lt-Gen Pain, who was an aide-de-camp to the Queen, handled all finances for himself and his wife and that one of the sisters set up bank orders to pay Lady Pain's utility bills following his death.
