A timetable has been set in the case of a teenager accused of murdering his friend in York.

Samuel Frederick Donley, 19, is charged with the murder on July 27 in Hamilton Drive West, Acomb, of Liam Miller, 20 of Terrington, near Malton.

He is also accused of the attempted murder of Theophilos Theophilou who was stabbed nearby, close to the junction with Lady Hamilton Gardens.

No pleas were entered on Tuesday at Leeds Crown Court during a short preliminary hearing. Donley spoke over the video link from HMP Doncaster only to confirm his name and that he could hear the proceedings.

The court had previously been told Donley, of Hamilton Drive, accepts responsibility for the death of Mr Miller but Nicholas Lumley QC defending him said medical reports would be prepared on him before any plea is considered.

The prosecution was ordered to serve its papers by September 22 and a plea and case management hearing, originally set for October 2 was moved to October 30.

A trial date was provisionally set at the court for December 14 but could be altered later if necessary.

Donley’s parents and sister were in the public gallery for the hearing and the Recorder of Leeds, Judge Peter Collier QC was asked to consider bail in his case.

The judge said he had read a detailed application by Donley’s solicitors but until the psychiatric report was available on him and more evidence provided “greater clarity” about the circumstances of the case bail was not possible.

He told Donley: “I hope you can understand what I have said and the reasons I cannot grant you bail. Your solicitors have done everything possible but I have to make the decision in the absence of reports and I am not able to make a decision other than this at this time.”

He said he had set a timetable for the case and remanded Donley in custody.

Mr Miller had returned home for the summer from Liverpool John Moores University, where he was studying graphic design and illustration. He was a guitarist in the band Nocebo in which Donley was the singer.
