CITY OF YORK COUNCIL NOTICE OF MAKING THE YORK (COPPERGATE) (LOCAL BUS PRIORITY) TRAFFIC ORDER 2016
Notice is hereby given that on the 1st day of  December 2016 City of York Council, in exercise of powers under Sections 1, 2, 4, 19 and Schedule 9 of the Road Traffic Regulation Act, 1984 ("the Act") and in pursuance of powers granted by the Secretary of State under Section 144 of the Transport Act 2000 (the 2000 Act) and the Bus Lane Contraventions (Penalty Charges, Adjudication and Enforcement) (England) Regulations 2005 ("the 2005 Regulations") and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Schedule 9 of the 1984 Act, proposes to make an Order which will have the effect of: Designating the whole length of the carriageway of Coppergate, York, as a Local Bus Lane tooperatedailyfrom8am to6pm with arelaxation oftheOrderfrom10am to4pmdailyto allow access to vehicles for the delivery of goods to premises on or adjacent to that length. The Order comes into effect on the 9th day of January 2017. A copy of the Order incorporating maps can be inspected at the Reception, West Offices, Station Rise, York, during normal business hours. Any person who wishes to question the validity of the Order or any of its provisions on the grounds that it is not within the powers of the Road Traffic Regulation Act 1984 as amended or that a requirement of any regulation thereunder has not been complied with may, within 6 weeks from the date of making of the Order, make application for that purpose to the High Court. Decriminalised Bus Lane Enforcement City of York Council, (The Council), being a designated authority under paragraphs 1 (1) and 2 (1) of Schedule 3 of the Road Traffic Act 1991 (Permitted and Special Parking Areas outside London) and an Approved Local Authority for Bus Lane Enforcement by virtue of Section 144 (3) of the Transport Act 2000 (Civil Penalties for Buses /Local Bus Lane contraventions) in accordance with regulations and guidance given by the Secretary of State under Section 144 of that Act, hereby gives notice that as from 0001 hours on the 9th day of January, 2017 the Local Bus Lane in Coppergate, York will be subject to Civil Enforcement (by camera) and the Penalty Charge in respect of any contravention of regulations appertaining to that Local Bus Lane, when so enforced, will be £60 such penalty to be reduced to £30 where payment is made within 14 days. The Penalty Charge will be increased to £90 where, in order to secure payment, a 'Charge Certificate' has been served on the vehicle owner following expiry of the statutory period for payment as set out in a 'Notice to Owner'. Explanatory Note The whole of Coppergate will be designated a Local Bus Lane between 8am and 6pm daily commencingon 9th January2017andwillbesubjecttoCivilEnforcement(bycamera)by theCouncil. ThisNoticesetsoutthechargesthatwillapplyinrespectofCivilEnforcement should the regulations concerning the Local Bus Lane in Coppergate be contravened. The Civil EnforcementofPenaltyChargesaccord with the Departmentfor Transportguidelines on Bus Lane enforcement. TEMPORARY TRAFFIC RESTRICTIONS Notice is hereby given that City of York Council (the Council), in exercise of powers under Section 14(1) of the Road Traffic Regulation Act 1984 (the Act), made an Order on the 1st day of December 2016 in respect of the location numbered (1). Additionally, the Council, not less than 7 days from the publication of this Notice, intends to make an Order under Section 14(1) oftheActin respectofeach ofthelocationsnumbered (2)and (3). (1) HOWDEN LANE, YORK This Order prohibits vehicles from proceeding and waiting in Howden Lane, York between its junctions with A19 and B1222 (closed road) during the period when tree felling works being undertaken thereon that period commencing at 0900hrs and ending at 1500hrs on the 8th day of December 2016 (works period) or on a date when the works have been completed whichever is the earlier. This is to ensure that the said works can be carried out safely. An alternative route for diverted traffic will be available during the works period. (2) HAXBY STATION LEVEL CROSSING, HAXBY This Order will prohibit vehicles from proceeding through the HaxbyStation Level Crossing on Station Road, Haxby (closed road) during the period commencing at 2315hrs on the 13th day of December 2016 and ending at 0600hrs on the 14th day of December 2016 (works period) or at time when track maintenance works have been completed whichever is the earlier. An alternative route for diverted traffic will be available via Station Road, Towthorpe Road, Strensall Road, A1237, York Road, Station Road and vice versa. (3) COPMANTHORPE LANE, BISHOPTHORPE This Order will prohibit (i) vehicles from proceeding and waiting in that length of Copmanthorpe Lane, Bishopthorpe between its junctions with Appleton Road and Kirkwell (closed road) and (ii) pedestrians and vehicles from proceeding in the footpath on the southsideofCopmanthorpeLane,BishopthorpebetweenitsjunctionswithAppletonRoad and Kirkwell (closed footpath) during the period commencing at 0001hrs on the 19th day of December 2016 and ending at 2400hrs on the 23rd day of December 2016 or at a time/date when footpath reconstruction works being undertaken to the closed footpath have been completed whichever is the earlier. This is to ensure that the said works can be carried out safely. An alternative route for diverted pedestrians and vehicles will be available during the works period. The above temporary Orders will not prohibit works or emergency access nor will they prohibit access to premises provided that access is not prevented by on-going works or safety concerns.
