ENVIRONMENT AGENCY ANNOUNCEMENT OF INTENTION NOT TO PREPARE AN ENVIRONMENTAL STATEMENT Regulation 5 of the Environmental Impact Assessment Land Drainage Improvement Works (Amended) Regulations 1999 S11999/1783 York FAS: Cell B11 and B12; Lower Bootham Improvements
The Environment Agency gives notice that it proposes to carry out improvement works to the flood defences on the River Ouse in the City of York between Westminster Road (NGR SE5917752589) and Marygate (NGR SE5976752046), a distance of 0.92 kilometres. The proposed improvement works will involve the following:
? The construction of a 90m long, flood wall in front of the upper boathouse at St. Peter's School sports pitches;
? Raising of the existing flood embankment from the upper boathouse at St. Peter's School to Almery Terrace by approx. 800mm;
? Raising the defence level of Almery Terrace flood wall incorporating glass panels and new flood gates;
? Raising of the existing steps at the eastern end of Almery Terrace;
? Raising the existing floodwall downstream of Scarborough Bridge and replacement of the pedestrian flood gate;
? Raising the existing floodwall along Earlsborough Terrace with glass panels and replacement of the flood gates;
? Raising the existing Marygate floodwall, replacement of the flood gate and raising of the flood gate with demountables;
The improvement works form part of the wider works within the York Five Year Plan project The Environment Agency considers that the improvement works are not likely to have significant effects on the environment and does not intend to prepare an environmental statement in respect of them. With reference to Schedule 2 of the Environmental Impact Assessment (Land Drainage Improvement Works) Regulations 1999 (as amended), as well as the characteristics of the improvement works, the location of the improvement works and the type and characteristics of the potential impact, it is considered that the proposed works will not have a significant effect on the environment The following mitigation and preventative measures have been considered:
? Consideration of materials that are in keeping with the current landscape
? Consideration of the impact to potential archaeological resources by having a watching brief during excavation works where required
? Impact on heritage assets - consideration of design to ensure no undue harm to the character and appearance of the conservation area.
An Environmental Report and associated environmental assessments (Arboricultural Impact Assessment and Heritage Appraisal Report etc.) have been prepared and are available from the Project Manager via the contact details below.
Any person wishing to make representations in relation to the likely environmental effects of the proposed improvement works should do so, in writing, to the address specified below, within 30 days of the date of publication of this notice.
