MICHAEL Barrymore has called for a second inquest into the death of Stuart Lubbock, who died in the swimming pool of his Roydon home.

Mr Barrymore has said previously unheard medical evidence supported his claim that severe anal injuries found on Mr Lubbock were inflicted after he left his Beaumont Park Drive home.

An inquest, held in the council chamber at the Civic Offices, Epping, heard that Mr Lubbock suffered internal injuries and might have been the victim of a serious sexual assault before his death.

But Mr Barrymore's lawyers have now obtained a statement from nurse Stuart Nairn who carried out a series of checks on Mr Lubbock using a rectal thermometer, saying he saw no evidence of anal injuries.

Mr Barrymore told a Sunday newspaper: "I'm not standing up on a platform and just saying this (injury) did not happen.

"It's a fact it did not happen. My solicitor has sent a seven-page report of the evidence that was not raised at the inquest."

The entertainer's comments followed the news that he will not be charged with perjury despite allegations that he lied at the inquest into Mr Lubbock's death. Mr Lubbock, a 31-year-old butcher, was found floating in Mr Barrymore's pool in March 2001.

Mr Barrymore told the inquest he had not tried to rescue him because he could not swim, a claim his ex-wife, Cheryl, later said was untrue.

The perjury allegations were referred to police following the inquest, but the Crown Prosecution Service has decided not to proceed with the matter.

An Essex Police spokeswoman said someone would only be prosecuted for perjury if there was evidence that false statements were made which would have made a fundamental diffference to the outcome of an enquiry.
