A BURGLAR who was disturbed by a householder during an early morning attempted break-in has been sent to prison.

Tyrone Savory, 22, of Haverah Court, York, was charged with burglary and attempted burglary.

He appeared before York Crown Court on Tuesday, and Anthony Moore, prosecuting, told the court Savory had stolen a motorbike and equipment worth more than £2,500 as well as two helmets and bike leathers from a garage in Pinfold Avenue, Sherburn-in-Elmet.

Mr Moore said the offences were committed while Savory was on a suspended sentence over an attempted burglary offence.

The court heard a blood sample found at the scene was later proven to be a match for Savory.

Also his alibi – that he was at his mother’s home all evening – was refuted by his mother.

The bike was recovered from Savory’s brother, but the rest of the gear was never found.

The attempted burglary offence referred to an attempted break-in at a property in Oakdale Road, when the owner confronted him in their home at about 5am during the incident last year.

Mark Partridge, for Savory, told the court the defendant had been a drug user at the time of the offences, but had been in custody since November, where he had “taken every step he felt he could do and was made available to him to address that habit”.

Judge Neil Clark said: “Burglary, particularly domestic burglary, is a very serious offence, and the reason is really obvious to anyone who applies any thought to it.

“People should feel safe and secure in their homes.

“A drug problem is not an excuse, and is an aggravating circumstance in some ways, but one you have taken steps to deal with.

“I urge you to seek voluntary help in the community following your release.

“Whatever is said in court there is only one person who can deal with that issue.”

Savory was sentenced nine months for attempted burglary, two months for burglary, and four months for breach of a suspended sentence – a total of 15 months in prison.
