DRIVERS have been warned they can still be over the drink-drive limit the morning after the night before.

Brendan Shane Carlyle, 46, was more than twice the drink-drive limit when he was stopped by police in Stonebow, York, on February 7, York Magistrates’ Court heard.

His solicitor, Craig Robertson, said Carlyle had been out with his wife the evening before and at 4am got a call from his daughter asking to be picked up.

Mr Robertson said: “He didn’t think that he had been drinking. He simply got up and went out.”

District judge Adrian Lowe told Carlyle: “You made a very foolish decision when you had had a great deal to drink and had had a sleep. Almost on a weekly basis I deal with defendants charged with drink driving who do so and say they felt fine to drive. You took a risk and you were caught.”

Self-employed builder Carlyle, 46, of Fifth Avenue, Tang Hall, pleaded guilty to drink driving. He was banned from driving for 20 months, fined £300 and ordered to pay £85 prosecution costs and a £30 statutory surcharge.

Katie Varlow, prosecuting, said a member of the public called the police because they had seen a car nearly collide with a bollard.

When the police arrived, they found Carlyle in his car, which was not moving. He was talking on his mobile phone.

A breathtest gave a reading of 78 microgrammes in 100 millilitres of breath. The legal limit is 35.

Mr Robertson said Carlyle was phoning his daughter to find out exactly where she was.
