OFFICIALS are investigating claims that diggers were at work on a York building site on Spring Bank Holiday Monday - in contravention of planning conditions.

Osbaldwick councillor Mark Warters has demanded enforcement action from City of York Council after what he claims is just the latest breach of restrictions on working hours on the Derwenthorpe site.

He sent officers photos of construction work which he said was taking place at 2.30pm on Monday,.

He said he would have thought that the position on working hours restrictions would have been made clear by now to David Wilson Homes and the Joseph Rowntree Housing Trust, who are behind the 540-home development on York's eastern outskirts.

"Until such time as robust action is taken by the council on this matter, the developers will continue to ignore the planning conditions as all concerned with this site have since day one of the construction," he claimed.

He said he looked forward to the enforcement team dealing with the matter with the same tenacity as they did with other issues locally.

He told The Press: "There is no point in the council making conditions when planning consent is granted if it doesn't enforce them and take action if they are broken."

A council spokeswoman said that Bank Holiday working was not allowed and the complaint by Coun Warters was being investigated.

Clare Harrigan, Head of Construction at Joseph Rowntree Housing Trust, said it had not received any complaints or queries from local residents about this issue.

"We can confirm however that no site work should be taking place on a Bank Holiday. she said. "We have raised this with David Wilson Homes.”

A spokesman for David Wilson Homes was unavailable for comment.
