Level-crossing lorry driver spared prosecution

THE driver of a Nestlé lorry that became stuck under a York level crossing barrier has been spared prosecution.
As The Press reported in July, the lorry became lodged under the closing barriers at the Wigginton Road crossing, narrowly avoiding a collision with an oncoming train. The lorry was heading along Wigginton Road towards the Nestlé factory and the city centre.
British Transport Police said at the time that it would issue the driver with a notice of intended prosecution but a spokesman has now told The Press that, following advice from the Crown Prosecution Service, no further action will be taken against the driver.
