A BINGE-drinking bully must spend every Friday and Saturday night at home after he and a friend beat up another man in Selby town centre.

Daniel May, 20, could have been sent to jail after he punched Ashley Fisher in Finkle Street and knocked him unconscious, because he was already on a suspended prison sentence for kicking the head of a man in Gowthorpe.

But Recorder Julian Smith, who watched a video of the incident that began with May and an accomplice bullying Mr Fisher outside a takeaway, decided to impose the two-night a week curfew instead.

The judge told May: “It is perfectly clear to me you were bullying, mocking and belittling an individual who was doing nothing more than going out for the evening.”

May had admitted spending £120 a night on alcohol.

“Clearly you are drinking not only expensive drinks but a massive quantity of them. The harm you are doing to yourself is obvious; that is your business. The harm you are doing to others is clear,” said the judge.

He tagged May, who was ordered to stay at home between 7pm and 5am on Friday and Saturday nights, and imposed 12 months’ supervision and 150 hours’ unpaid work.

May, of Flaxley Road, Selby, must also pay £100 compensation to Mr Fisher, £420 costs and a £60 victim surcharge after admitting assault and breaching the suspended sentence, which continues to run.

That was imposed a year ago for causing grievous bodily harm to William Pepper in an alleyway near the New Inn. Mr Pepper suffered a fractured cheekbone, a black eye and loosened teeth.

Neal Kutte, mitigating, said May’s sentence for the Gowthorpe attack had not included rehabilitation work on his binge drinking. On evenings when he was not working he went out and drank to excess, leading to him becoming violent. But he now accepted he had a drink problem.

Bronia Hartley, prosecuting, said May and an accomplice had mocked their victim outside the takeaway in Finkle Street.

Then, with their victim backed against the takeaway’s wall, the accomplice hit him and May punched him so hard he fell to the ground unconscious. Police rapidly arrived and arrested both attackers.
