Jason Angell is spared jail for theft
A THIEF who stole a laptop and £1,400 from a parked car has been spared a prison sentence.
Jason Alan Angell, of Wycliffe Avenue, York, admitted smashing the window of a car parked near Skeldergate Bridge and taking the laptop and cash.
Angell, 45, appeared before York Magistrates’ Court, facing one charge of theft from a motor vehicle and a separate charge of theft of a bottle of whisky at a later date – both of which were carried out while he was subject to a conditional discharge.
The court heard a member of the public phoned police after seeing two men break into the car on July 14.
Police arrested Angell and another man later that day. When his home was searched, they found an envelope containing £1,400 and the computer, both of which were returned to the owner.
The court also heard that on August 12, Angell was stopped by staff at Lidl in Thanet Road, York, after they saw him take a bottle of whisky worth £12.49.
Leanne Robin-Hicks, for Angell, said drinking had been an influence in both crimes. She said he had been compliant with the probation service for his previous offences, including common assault, but “clearly there were still areas that need to be worked on, not only with an alcohol problem, which he is aware he needs to address”.
Magistrate Dorianne Butler told Angell: “As a direct alternative to custody, we are going to revoke your current community order and resentence you to a 24-month community order.
“If you commit any offence while you are on this or you break any of the requirements, your sentence will be increased or you may be re-sentenced. We have said this is a direct alternative to custody, so you understand it is up to you now.”
Angell was also ordered to take part in a course to deal with his alcohol problem, will undergo a supervision requirement for the duration of the community order, and must pay £100 in compensation towards the smashed window of the car.
