Nestlé victory over use of purple wrappers

YORK chocolate giant Nestlé has won a protracted legal battle over the right to use the colour purple on wrappers.
The Court of Appeal has upheld an objection by the York confectioner against Cadbury’s proposal to trade mark its Dairy Milk “Purple” colour across a broad range of products.
Nestlé was challenging a ruling granting Cadbury a trademark for the distinctive tint, called pantone 2865. Cadbury successfully applied to register the colour as a trademark for chocolate in 2008.
A spokesman for Nestlé said it welcomed the Court of Appeal’s decision, adding: “We believe this was the right outcome from a legal perspective.”
